Marken Regulatory Update: Updated Implementation Schedule for the EU Import Control System (ICS2) Release 3 

The European Union (EU) has changed the dates previously announced for the implementation of the third release of the Import Control System 2 (ICS2). 

Under the updated Union Customs Code (UCC) Work Program, which defines the legal framework for customs rules and procedures in the EU customs territory, economic operators carrying goods by sea, inland waterways, road, and rail will have to submit a complete Entry Summary Declaration (ENS) dataset to ICS2 starting on the following dates: 

  • 3 June 2024: maritime and inland waterways carriers 
  • 4 December 2024: maritime and inland waterways house level filers 
  • 1 April 2025: road and rail carriers 

The ICS2 is EU’s advance cargo information system, aimed to introduce new customs safety for the EU’s single market as well as safety for EU citizens by collecting data about all goods entering the union prior to the arrival. Economic Operators will have to declare safety and security data to ICS2 through the ENS. 

As with the previous releases, the ICS2 means a greater push for shippers and importers for commercial documents to be completed with appropriate and clear product descriptions and especially valid Harmonized Commodity codes, as HS codes will be required to be added to the AWB and HAWB level. 

To guarantee a smooth transition, traders should review their inbound EU and transit lanes to confirm all the invoices used are in compliance with the requirement.
